Fair Housing Act, 42 U.S.C. 3604 (1968, as amended). Section 804(a). Makes it unlawful to refuse to sell or rent, or to otherwise make unavailable or deny, a dwelling to any person because of race, color, religion, sex, familial status, or national origin.

Fair Housing Act, discrimination in the sale or rental of housing. Section 804(a) contains the phrase “otherwise make unavailable or deny,” which the Supreme Court in Inclusive Communities (576 U.S. 519, 2015) held constitutes effects-based language supporting disparate-impact claims. This is the language the CFPB’s Regulation B final rule (FR doc 2026-07804) says ECOA lacks.
