Section 2 states the policy “to eliminate the use of disparate-impact liability in all contexts to the maximum degree possible.” Section 3(b) revokes the 1973 Presidential approval of the Department of Justice Title VI regulations “as applied to the words “or effect” in both places they appear in 28 C.F.R. 42.104(b)(3).” Section 6(b) directs the Secretary of Housing and Urban Development, among others, to evaluate pending proceedings that rely on disparate-impact liability.
