The Equal Credit Opportunity Act. Section 701(a)(1) makes it unlawful for any creditor to discriminate against any applicant, with respect to any aspect of a credit transaction, on the basis of protected characteristics. The operative verb is “discriminate” with no effects-based modifier. Enacted 1974. Implemented by Regulation B (12 CFR Part 1002).
