Read 2026-09-29 through the eCFR versioner API (/api/versioner/v1/full/2026-09-25/title-24.xml?part=1&section=1.4). The rule as it stands today: paragraph (b)(3) says an applicant or recipient “may not make selections with the purpose or effect of excluding individuals from, denying them the benefits of, or subjecting them to discrimination under any program to which this part 1 applies, on the ground of race, color, or national origin.” Paragraph (b)(6)(i) says the recipient “must take affirmative action to overcome the effects of prior discrimination.” These are the words the proposal would remove, read in the rule itself and not only in the notice’s description of it.
